These Terms and Conditions govern your access to and use of coachtonymartin.com, including its content, assessments, coaching services, digital products, downloads, and online shop.

By accessing the website, purchasing a product, booking a session, or participating in a program, you agree to these Terms and Conditions. If you do not agree, do not use the website or purchase or participate in our services.

These Terms and Conditions, together with any additional terms presented during a purchase or enrollment, form the agreement between you and Transformational Encouragement LLC.

2. Eligibility

You must be at least 18 years old to purchase products, enroll in programs, book coaching services, or participate in our coaching programs.

By using the website or purchasing or participating in our services, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement.

3. Our Services

Transformational Encouragement provides Christian life coaching and faith-based personal development services. Our offerings may include:

Christian life coaching;

A six-month one-to-one and group coaching program;

Group teaching, prayer, encouragement, and accountability;

Online coaching sessions and discovery calls;

Digital products, guides, courses, and downloads;

The “3-Step Guide to Deepening Your Faith”;

The “3-Step Guide to Finding Your Purpose”;

Online assessments and quizzes;

Practical exercises and personal development materials; and

Other digital products or services offered through our online shop.

We may add, change, suspend, or discontinue any service, product, feature, or program at any time. The specific description, price, schedule, and terms shown at the time of purchase or enrollment will apply to that purchase or enrollment.

4. Coaching Is Not Professional Advice

Our coaching and personal development services are educational and supportive in nature. They are not:

Psychotherapy or counseling;

Medical or healthcare services;

Mental health treatment;

Legal advice; or

A substitute for care from a licensed or qualified professional.

No doctor-patient, therapist-patient, attorney-client, or other professional-client relationship is created through your use of our website or services. Our services are provided only as coaching.

You should seek advice from an appropriately licensed professional whenever you need medical, mental health, psychological, legal, financial, or other professional assistance.

Do not use our services for emergencies or crisis situations. If you believe that you or another person is in immediate danger, call 911 or contact the appropriate emergency or crisis service in your location. If you are experiencing thoughts of suicide or self-harm in the United States, call or text 988 to reach the Suicide & Crisis Lifeline.

5. Payments and Billing

Payments for products and services may be processed through Stripe or another payment processor identified at checkout.

By submitting payment information, you authorize us and our payment processor to charge the payment method you provide for:

The purchase price;

Applicable taxes;

Recurring subscription or installment payments, if applicable; and

Any other amount clearly disclosed to you before purchase.

You agree to provide accurate and complete billing information and to keep that information current.

Prices are displayed at the time of purchase. We may change prices in the future, but a price change will not affect a completed purchase unless the change is separately agreed to by you.

You are responsible for applicable sales tax, use tax, or other taxes unless we are required by law to collect and remit those taxes.

If a payment fails, expires, is reversed, or is disputed, we may suspend or cancel your access to the related product or service until payment is successfully completed. We may also charge any applicable recurring payment after notifying you through the contact information associated with your account, where required by law.

6. Refunds and Cancellations

30-Day Refund Window

Customers may request a full refund of any purchase — including the six-month coaching program, coaching sessions, digital products, guides, and assessments — within 30 days of purchase or before the customer's first one-to-one coaching session, whichever comes first (the “30-day refund window”).

If a refund is issued, the customer's access to all program materials, courses, group sessions, downloads, community spaces, and any other content provided as part of the purchase ends immediately upon the refund, and the customer agrees to stop using and to delete any downloaded materials.

If you request a refund within the 30-day refund window, we will honor the request and issue a full refund to the original payment method.

For coaching programs, the refund window closes at the earlier of (a) 30 days from the date of purchase, or (b) the customer's first one-to-one coaching session. Once the customer has attended their first one-to-one coaching session, or once 30 days have passed, whichever happens first, no further refunds or credits will be issued.

After the 30-day refund window has passed, all payments are non-refundable, and no refunds or credits will be issued.

7. Confidentiality

We intend to keep information shared during individual coaching conversations confidential. However, confidentiality has limits.

We may disclose information when we reasonably believe disclosure is necessary to:

Prevent a serious risk of harm to you or another person;

Address suspected abuse or neglect of a minor or vulnerable person;

Comply with a court order, subpoena, or other lawful legal process;

Comply with applicable law; or

Protect the rights, safety, or property of Transformational Encouragement, our clients, or others.

Information shared in group coaching sessions is not fully confidential. Other participants may hear or receive information shared during those sessions, and we cannot guarantee that other participants will keep it confidential.

Communications made through third-party booking, email, video-conferencing, payment, or other technology platforms may also be subject to those providers’ security and privacy practices. We cannot guarantee that communications transmitted through third-party platforms will remain fully confidential.

You should use reasonable care when deciding what personal, sensitive, or confidential information to share through group sessions, online forms, email, or third-party platforms.

8. No Guarantee of Results and Disclaimers of Warranties

We do not promise or guarantee any particular personal, spiritual, professional, financial, emotional, relational, health, or other result from using our website or services.

Your results depend on many factors, including your circumstances, participation, decisions, effort, and actions. Any examples, testimonials, or statements about possible results are illustrative only and are not guarantees.

To the fullest extent permitted by law, the website, coaching services, digital products, downloads, courses, assessments, and other materials are provided “as is” and “as available.” We disclaim warranties of any kind, whether express, implied, statutory, or otherwise, except for warranties that cannot legally be excluded.

We do not warrant that:

The website or services will always be available;

The website or services will be uninterrupted, secure, or error-free;

Content will always be accurate, complete, or current;

The services will meet your particular needs or expectations; or

Any defect or error will be corrected.

9. Limitation of Liability

To the fullest extent permitted by law, Transformational Encouragement LLC and its owners, officers, employees, contractors, coaches, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, loss of data, loss of goodwill, or business interruption arising out of or related to:

Your use of or inability to use the website or services;

Your participation in coaching or group sessions;

Your reliance on any content or information;

Any product or service purchased through the website;

Unauthorized access to or alteration of your information;

Any third-party website, platform, product, or service; or

Any other matter related to the website or services.

To the fullest extent permitted by law, our total liability for claims arising out of or relating to the website or services will not exceed the amount you paid to us for the specific product or service giving rise to the claim during the 12 months before the event giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability for fraud, willful misconduct, or other liability that applicable law does not permit us to limit.

10. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Transformational Encouragement LLC and its owners, officers, employees, contractors, coaches, agents, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

Your use of the website or services;

Your violation of these Terms and Conditions;

Your violation of another person’s rights;

Your unlawful, abusive, or harmful conduct; or

Your content or information submitted through the website or services.

We reserve the right to take over the exclusive defense of any matter subject to indemnification. You agree to cooperate with that defense.

11. Intellectual Property

The website and its content are owned by or licensed to Transformational Encouragement LLC. This includes, among other things:

Text;

Logos and branding;

Videos and audio;

Guides and downloads;

Courses and lessons;

Assessments and quizzes;

Worksheets and exercises;

Graphics, photographs, and other images;

Coaching materials; and

The organization and design of the website.

Subject to these Terms and Conditions, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use purchased materials for your own personal, non-commercial purposes.

You may not, without our prior written permission:

Copy, reproduce, or republish our content;

Resell or redistribute our products or materials;

Share access to purchased courses, programs, or downloads;

Record coaching sessions or group sessions;

Upload our materials to another website or platform;

Modify or create derivative works from our materials;

Use our content for commercial purposes;

Use our content to train, develop, or operate an artificial intelligence system;

Remove copyright, trademark, or other ownership notices; or

Represent our content or materials as your own.

All rights not expressly granted to you are reserved by Transformational Encouragement LLC.

12. Acceptable Use and User Conduct

You agree to use the website and services lawfully and respectfully. You may not:

Use the website or services for an unlawful purpose;

Violate any applicable law or regulation;

Interfere with or disrupt the website, coaching sessions, or group sessions;

Attempt to gain unauthorized access to accounts, systems, or materials;

Introduce viruses, malicious code, or harmful technology;

Harass, threaten, abuse, or intimidate us, our staff, coaches, or other participants;

Engage in discriminatory, hateful, or violent conduct;

Disrupt group discussions or prevent others from participating;

Record, copy, or distribute group or coaching sessions without permission;

Impersonate another person or misrepresent your identity;

Submit false, misleading, or unlawful information;

Use another person’s account or payment information without authorization; or

Use our materials or services to compete with us or create a substantially similar commercial offering.

You are responsible for your own communications and conduct during coaching sessions, group sessions, and online interactions.

13. Third-Party Links and Services

The website may contain links to or integrations with third-party websites, platforms, and services, including:

Stripe and other payment processors;

Booking and scheduling tools;

Email and newsletter platforms;

Video-conferencing services;

Social media platforms;

Analytics providers; and

Other technology or service providers.

Third-party services are governed by their own terms, privacy policies, and practices. We do not control and are not responsible for third-party services, content, security, availability, or practices.

You use third-party services at your own risk. We do not endorse third-party products or services merely because we link to or use them.

14. Termination and Access

We may suspend, restrict, or terminate your access to the website, coaching services, programs, digital products, or other materials at any time if we reasonably believe that:

You have violated these Terms and Conditions;

You have failed to make a required payment;

Your conduct harms or threatens other participants, our staff, or our business;

You have misused or shared protected materials;

Your use creates a legal, security, or operational risk; or

Termination is otherwise appropriate for business or safety reasons.

We may also refuse service to anyone to the extent permitted by law.

If access is terminated because of your violation of these Terms and Conditions, you may not be entitled to a refund. Provisions that by their nature should survive termination will remain in effect, including provisions concerning payments, intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute-related terms.

15. Governing Law and Venue

These Terms and Conditions and your use of the website and services are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles.

To the fullest extent permitted by law, any legal action or proceeding arising out of or relating to these Terms and Conditions, the website, or the services must be brought exclusively in the state or federal courts located in Jones County, Mississippi. You consent to the jurisdiction and venue of those courts.

Nothing in these Terms and Conditions limits rights or remedies that cannot legally be waived.

16. Changes to These Terms

We may update these Terms and Conditions from time to time. When we make changes, we will post the updated version on the website and revise the effective date at the top of this document.

Your continued use of the website or services after updated Terms and Conditions are posted means that you accept the updated terms. If a change materially affects a paid program or existing enrollment, we may provide additional notice where appropriate.

17. General Terms

Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in effect.

Entire Agreement

These Terms and Conditions, together with any applicable purchase terms, enrollment agreement, Privacy Policy, Warranty page, and other terms expressly incorporated into them, constitute the entire agreement between you and Transformational Encouragement LLC concerning the website and services.

Assignment

You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer these Terms and Conditions in connection with a merger, sale, reorganization, or transfer of all or part of our business.

No Waiver

Our failure to enforce any provision of these Terms and Conditions does not waive our right to enforce that provision later. A waiver must be in writing to be effective.

Electronic Communications

You agree to receive communications from us electronically, including by email, website notices, booking platforms, or other electronic methods. Electronic communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.

No Partnership or Agency

These Terms and Conditions do not create a partnership, joint venture, employment relationship, agency relationship, or fiduciary relationship between you and Transformational Encouragement LLC.
